What changed
The case is Doe 3 v. Indyke, No. 1:24-cv-01204, in the Southern District of New York before Judge Arun Subramanian. It alleges that Indyke and Kahn, Epstein’s longtime lawyer and accountant, helped build the financial structure of his trafficking operation. These are allegations, and both men deny them.
The unopposed motion for preliminary approval was filed on February 19, 2026, and Judge Subramanian granted preliminary approval on March 3, 2026. The settlement pays up to $35 million, or $25 million if fewer than 40 eligible class members come forward, according to news reports.
After a hearing on September 16, 2026, the court ordered further notice to the class and set a final approval hearing for December 2, 2026. An objection to the settlement was filed in August.
What it means
Until final approval, the settlement can still change or fail.
A settlement without an admission is neither an admission nor an exoneration. The defendants’ lawyer has said neither man “admitted wrongdoing or conceded misconduct” (Reuters, via Yahoo).
